Terms of Service

Important: LexisTrace is an organizing and analysis aid only. It is not a law firm and does not provide legal advice. Use of LexisTrace does not create an attorney-client relationship. Always consult a licensed attorney for legal advice.

1. Acceptance of Terms

By accessing or using LexisTrace (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use after an update constitutes acceptance.

2. Nature of the Service

LexisTrace is a private evidence organizing and analysis tool. The Service allows you to upload documents, tag evidence by legal claim, generate organizing outputs (including Counsel Handoff Packages and chain-of-custody logs), and invite attorneys and witnesses to access specific views of your case.

LexisTrace is NOT a law firm and does NOT provide legal advice. Nothing in the Service — including the case dashboard, pillar-strength indicators, gap analysis, statement of facts output, or chain-of-custody log — constitutes legal advice, legal strategy, or a legal opinion. The pillar-strength and case index features are organizing indicators only. They do not constitute legal or statistical proof and are not admissible in court. The chain-of-custody log is a tamper-evidence aid for your own work product — it is not a legally recognized forensic chain-of-custody attestation.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement. The Service is intended for individuals and legal professionals operating in civil (not criminal) legal matters.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for losses resulting from unauthorized use of your account.

5. Acceptable Use

You agree not to:

  • Upload content that is illegal, defamatory, or that infringes third-party rights
  • Use the Service to harass, stalk, or harm any individual
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use automated tools to scrape or extract data from the Service without permission
  • Misrepresent the outputs of LexisTrace as legal advice, legal certification, or court-admissible forensic records
  • Use the Service for criminal legal matters (the Service is designed for civil cases only)

6. Your Content

You retain ownership of all files and content you upload to LexisTrace ("Your Content"). By uploading Your Content, you grant LexisTrace a limited, non-exclusive license to store, process, and display Your Content solely to provide the Service to you. We do not claim ownership of Your Content and we do not use it for any purpose other than providing the Service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LEXISTRACE MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE PILLAR-STRENGTH INDICATORS, CASE INDEX, GAP ANALYSIS, AND ALL OTHER ANALYTICAL FEATURES ARE PROVIDED FOR ORGANIZING PURPOSES ONLY AND DO NOT CONSTITUTE LEGAL ADVICE, LEGAL ASSESSMENT, OR EXPERT OPINION OF ANY KIND. LEXISTRACE DOES NOT GUARANTEE ANY LEGAL OUTCOME.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEXISTRACE AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR DAMAGE TO REPUTATION, ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL LEXISTRACE'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless LexisTrace and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your account at any time if we determine you have violated these Terms. You may terminate your account at any time by contacting support. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the federal or state courts located in the United States.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice in the platform. Continued use after the effective date constitutes acceptance.
